Basic Policy for the proper handling of Personal Information

Nippon Tungsten Co. (hereinafter referred to as "the Company") strongly recognizes the importance of protecting the personal information of our customers, business partners, shareholders, employees, and other individuals (hereinafter referred to as "Personal Information"), and in order to comply with the "Act on the Protection of Personal Information" (hereinafter referred to as the "Personal Information Protection Act"), related laws, internal rules and other norms, we have established the following policy for handling Personal Information (hereinafter referred to as "the Basic Policy").

Based on this Basic Policy, we will strive to protect personal information appropriately.

2. Personal Information Protection Regulations

In order to implement this Basic Policy, the Company has established the "Personal Information Protection Regulations". The Company will make it known to all persons of the Company's Group (not only employees who are directly or indirectly engaged in the Company's business under the Company's direction and supervision within the Company's organization and who are in an employment relationship (regular employees, contract employees, temporary employees, part-time employees) but also directors, executive officers, audit and supervisory committee members, temporary employees, etc.) as well as other related parties, and will make continuous efforts to improve such an implementation of it.

3. Acquisition of Personal Information

When obtaining personal information from customers, business partners (hereinafter referred to as "Customers, etc.") and shareholders, we will publicly announce or notify the purpose of utilization, and when obtaining personal information directly from the person concerned in a contract or other written form, we will clearly state the purpose of utilization in advance and obtain the information by legal and fair means.

4. Purpose of utilization of personal information

In the course of its business activities, the Company will use personal information only to the extent necessary to achieve the purposes of utilization described below.

  1. Research, study, and analysis related to the Company Group's business management, business strategy, and sales strategy.
  2. Shared services operations of the Company Group.
  3. To respond to inquiries and requests from Customers, etc., and to contact the Customers, etc. regarding business negotiations and meetings.
  4. To provide information on the Company Group's products and services, etc.
  5. To provide information on and thank visitors for attending exhibitions, previews, and other events in which the Company Group exhibits.
  6. Provision of the Company Group's catalogs, samples, and other materials.
  7. Survey, implementation and analysis of questionnaires, etc.
  8. Contractual acts with the Customers, etc.
  9. Services related to the handling of shares, including general shareholders' meetings and dividends.
  10. To perform other businesses incidental to (1) through (9) above.

5. Security control measures

We take the following measures to prevent leakage, loss, or damage of personal information and to otherwise properly control personal data.

(Establishment of the Basic Policy)
  • We have established the Basic Policy to ensure the proper handling of personal information and to provide a point of contact for questions, comments, and complaints.
(Discipline for the handling of personal data)
  • For each stage of acquisition, utilization, storage, provision, deletion/disposal, etc. of personal data, we have established the Personal Information Protection Regulations regarding handling methods, responsible persons/persons in charge, and their duties.
(Organizational safety control measures)
  • A person responsible for the handling of personal data (Chief Privacy Officer) is appointed.
  • Clarification of the employees who handle personal data and the scope of personal data handled by such employees.
  • Establish a system for reporting to the Chief Privacy Officer in the event that a fact or indication of a violation of laws, regulations, or internal rules is detected.
  • Conduct periodic self-inspections of the status of personal data handling, as well as audits by other departments or external parties (internal audit department).
(Human security control measures)
  • Provide regular training to employees on key points keeping in mind the handling of personal data.
  • The confidentiality of personal data is included in the employment regulations.
(Physical security control measures)
  • In areas where servers and other important information systems that handle personal data, etc. are controlled (hereinafter referred to as the "Controlled Areas"), access control for employees, room access control, and restrictions on equipment, etc. brought in the Controlled Areas are implemented.
  • Establish areas where personal data, etc., are handled (hereinafter referred to as the "Handling Areas"), and implement measures to prevent unauthorized persons from accessing personal information.
  • Take measures to prevent theft or loss of equipment, electronic media, and documents that handle personal data.
  • Implement measures to ensure that personal data is not easily revealed when equipment, electronic media, etc. that handle personal data are carried, including within the business premises.
(Technical security control measures)
  • Implement access control to limit the scope of the persons in charge and the personal data handled by them.
  • Implement mechanisms to protect information systems that handle personal data from unauthorized external access or unauthorized software.

6. Provision of Personal Information to Third Parties

We will not disclose or provide personal information to third parties except in the following cases.

  1. When the prior consent of the person in question is obtained.
  2. When disclosure or provision of personal information is required by law.
  3. When it is necessary for the protection of the life, body, or property of an individual and it is difficult to obtain the consent of the Customer, etc.
  4. When it is especially necessary to improve public health or to promote the sound growth of children and it is difficult to obtain the consent of the Customer, etc.
  5. When it is necessary to cooperate with the national or local government in the execution of public affairs and obtaining the consent of the Customer or others may interfere with the execution of such affairs.
  6. When outsourcing to the extent necessary to achieve the purpose of utilization.
  7. When providing personal information to the parties listed in the following section "7".

We will jointly utilize personal information as follows.

We will provide personal information to third parties in foreign countries only with the prior consent of the individual in question.

11. Request for disclosure of personal information in our possession, etc.

When we receive a request for disclosure of personal data held by us from the person in question (or his/her representative), we will respond without delay within a reasonable period and to a reasonable extent, except in the following cases.
If we do not disclose the personal data, or if the personal data does not exist, we will reply to that effect within a reasonable period of time and to a reasonable extent.

  1. If there is a risk of harm to the life, body, property, or other rights or interests of the person concerned or a third party
  2. If there is a risk of causing significant hindrance to the proper conduct of our business
  3. If it would violate laws and regulations

In addition, when we receive a request for correction, addition, or deletion of personal data held by us from the person in question or his/her representative, we will respond to the request within a reasonable period of time and to a reasonable extent in accordance with the relevant law after accordingly conducting an investigation.

If the Customer, etc. wishes that we discontinue the utilization or erase his/her own personal data in our possession, we will do so within a reasonable period and to a reasonable extent after confirming the identity of the person making the request (or his/her representative).
We ask for your understanding and cooperation in the event that we stop using or delete part or all of the information, etc., as we may not be able to provide services that meet your request. (Please note that we may not be able to comply with your request for suspension of utilization or deletion of the information in our possession in accordance with applicable laws and regulations.)

Please note that we may not be able to respond to requests for disclosure, etc. that are not made in accordance with this procedure.
